Donation Terms & Conditions
IMPORTANT – PLEASE READ
- INTRODUCTION
- These Terms and Conditions govern all donations made to Keysoe Cuddle Therapy Centre CIC (14034449) of Keysoe International, Church Road, Keysoe, Bedfordshire, United Kingdom, MK44 2JP (we and us) by the Donor (you). By donating, you agree to these Terms and Conditions.
- Keysoe Cuddle Therapy Centre CIC is a Community Interest Company. It is a limited liability company incorporated under the Companies Act 2006 by the Registrar of Companies with the specific aim of providing benefit to a community.
- It is the Donors responsibility to familiarise themselves with these Terms and Conditions. If you do not understand or have any questions relating to these Terms and Conditions you should contact KCTC without delay for clarification using the contact details set out below at clause 10.
- DEFINITIONS
- “KCTC” refers to Keysoe Cuddle Therapy Centre CIC.
- “Donor” refers to the individual or entity donating.
- “Donation” refers to a one off financial contribution made to KCTC.
- “Donation Subscription” refers to a recurring automatic financial contribution made to KCTC.
- USE OF DONATIONS
- KCTC provides Animal Assisted Therapy to support adults and children who suffer with a variety of conditions such as ADHD, Autism, anxiety, depression, trauma, stress and learning difficulties. Please visit our website for more information on our work.
- Donations to KCTC will support the health and welfare of our therapy ponies, fund the provision of our services both on-site and in the local community, and other activities and requirements of the CIC.
- DONATION TYPES
- Donations can be made as a one off donation, or on a recurring basis through our Donation Subscriptions until cancelled.
- Donations can be made through our website, by post, or in person at our location.
- Donations Subscription will be a monthly recurring payment. We use a third-party to manage our subscription payments called WooCommerce Subscriptions. On subscribing the Donor will be invited to create an account. From there a Donor will be able to manage the subscription online.
- If a sponsorship pack is purchased alongside a Donation Subscription, please refer to our Terms & Conditions for The Supply of Goods for this product.
- The Donor warrants that the Donation has been given freely and they have no right to receive anything in return for the Donation.
- REFUNDS AND SUBSCRIPTION CANCELLATIONS
- All one off donations are non-refundable except in exceptional circumstances.
- Donation Subscriptions can be cancelled at any time via the Donors online subscription account.
- DONOR RIGHTS
- Donors will receive an email acknowledgment of their donation.
- Donors can stipulate their preferred method of communication by selecting the appropriate checkbox when processing their donation through the website.
- Donors may access, correct, or delete their personal information by contacting us using the contact details set out below at clause 10.
- REFUSING DONATIONS
- Donations will only be accepted from Donors that are in the best interests of KCTC.
- In certain circumstances we have a legal obligation to refuse or return a Donation. This can include but is not limited to if we believe they are from an illegal source, they come with illegal conditions, or the Donor does not have the mental ability to decide to donate as an example.
- In these circumstances we will be guided by the law regarding refusing and returning donations.
- LEGAL COMPLIANCE AND FINANCIAL INTEGRITY
- We are regulated under the Companies (Audit, Investigations and Community Enterprise) Act 2004 (“CAICE Act 2004”) and the CIC Regulations 2005.
- We ensure that all funds are used appropriately and are subject to regular audits. Our financial reports are available on request.
- LIMITATION OF LIABILITY
- Subject to Conditions 9.3 and 9.4, KCTC shall have no liability for any indirect or consequential loss, damage, costs or expenses, any loss of profits, loss of opportunity or loss of revenue whether foreseeable or not.
- KCTC is not liable for any misuse of donations by third-party processors.
- Nothing in these Terms and Conditions shall limit or exclude our liability in respect of death or personal injury caused by our own negligence or fraudulent act or omission or for any other liability which cannot by law be excluded or limited.
- Nothing in these Terms and Conditions shall affect the statutory rights of any Donor.
- AMENDMENTS TO TERMS AND CONDITIONS
- We reserve the right to amend these Terms and Conditions. Any changes will be posted on our website.

- DATA PROTECTION & PRIVACY POLICY
- We collect personal information such as name, address, and payment details to process your donation. This information is protected under the Data Protection Act 2018 and GDPR.
- Our website includes links to third-party website applications including Stripe and WooCommerce for payments. Clicking on those payment links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website, we encourage you to read the privacy notice of every website you visit.
- When you provide us with personal information (whether purchasing from us or registering with us or otherwise) by doing so you agree to our Privacy Policy in its entirety.
- DISPUTES
- If any dispute arises between us in relation to these Terms and Conditions, we shall use our reasonable endeavours to consult or negotiate with the Donor in good faith to resolve such disputes.
- ENFORCEMENT
- No failure or delay to enforce our rights under these Terms and Conditions, should be construed as a waiver of our right to do so.
- LAW
- These Terms and Conditions and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with English law.
- In the event of a dispute relating to these Terms and Conditions, any contract we have with the Donor or any other claim the Donor may have against KCTC (including in negligence) the Donor irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Conditions.
- Each of the paragraphs of these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain full and in force.
